Lorain woman survives dump truck flip

On Behalf of | Sep 18, 2024 | Truck & Bike Accidents

Life can change instantly and sometimes, survival hinges on a lucky break. For Luz De Leon, a routine drive turned into a harrowing experience when a dump truck flipped onto her vehicle. While she walked away with minor injuries, the incident could have easily turned into a nightmare.

Details of the crash

On a seemingly ordinary Monday, Luz De Leon was heading to a doctor’s appointment when her life took a dramatic turn. She stopped at a red light near Opportunity Corridor and Kinsman Rd. and noticed a dump truck turning left. The truck, carrying an unsecured load of metal coils, suddenly began to tip over. Luz instinctively ducked for cover, stretching her body across the passenger seat. This quick thinking likely saved her life as the truck landed on her Hyundai, crushing it.

Despite the accident’s severity, Luz crawled out of her vehicle before emergency responders arrived. She immediately called her father, grateful to be alive. The Ohio State Highway Patrol later reported several violations on the dump truck, including inoperable brake lights and inadequate brakes. The driver was cited for failure to control the load, and the car was placed out of service.

Possible liability

But what if Luz had not survived? In such tragic circumstances, determining liability becomes crucial. The company owning the dump truck, B&B Wrecking and Excavating, could face significant legal repercussions. The violations found in the truck’s examination report suggest negligence on the company’s part. Inadequate maintenance and failure to secure the load properly are serious oversights that can lead to fatal accidents.

In cases like these, the company could be held liable for wrongful death, and the victim’s family might pursue compensation for their loss. This could include medical expenses, funeral costs and emotional distress. The driver, too, might face legal consequences, mainly if found negligent in operating the vehicle.

Luz De Leon’s story is a powerful reminder of how quickly life can change. Her survival is a testament to quick thinking and perhaps a bit of luck. However, it also highlights the importance of accountability and safety in preventing such incidents. If you or a loved one has been a victim of an accident involving cars or trucks, consider consulting a legal professional to understand your rights and options.
