Product liability: Frito Lay recalls pita chips over allergy risk

On Behalf of | Feb 21, 2019 | Product Liability

Having food allergies often causes many Ohio residents and people elsewhere to pay close attention to the food they consume. They commonly check packages and ingredients to determine whether their allergen may be present in a particular product. Of course, even taking these precautions may not be enough if a company fails to disclose an allergen or puts a product in the wrong packaging. When this happens, negatively affected consumers may have reason to file product liability claims.

It was recently reported that Frito Lay has issued a recall for it’s Stacy’s Simply Naked Pita Chips. The Simply Naked chips essentially have no added flavor ingredients, but in this situation, another flavor of chips was put into the Simply Naked packaging. As a result, consumers may purchase a bag of chips thinking that they do not have any added flavor ingredients only to be exposed to a possible milk allergen.

The report indicated that at least one allergic reaction had been reported in connection with the packing mix up. It was not disclosed how severe the reaction to the product was. The recall reportedly affects 228 bags of the Stacy’s Simply Naked Pita Chips, and no other Stacy’s brand products are affected.

Allergic reactions can range in severity depending on each person’s particular connection to that allergy. In some cases, allergic reactions can be severe, life-threatening or even fatal. If Ohio residents suffer serious allergic reactions due to undisclosed allergens or packaging mistakes like this one, they may want to gain information on product liability law and obtain an assessment of their possible case from legal professionals to better understand their legal options.
